A coalition of 3 law firms who are leaders in mass tort litigation filed its first 3M defective ear plug lawsuit. The coalition — Gibbs Law Group, Isaac Wiles, and Stueve Siegel Hanson — plan to file many more on behalf of veterans or active service members with hearing loss due to alleged defects in the design of the 3M dual-ended Combat Arms earplugs, issued to the military from 2003 to 2015.
The earplug lawsuit complaint alleges that:
[3M] launched an investigation into why the “closed” green end of the earplugs failed during the testing. It discovered that the earplugs were defective. First, [3N] discovered that because the Combat Arms Earplugs are so short, it is difficult to insert the earplug deep enough into the ear to achieve a proper fit. Second, [3M] discovered that the flanges on one side of the plug interfered
with the proper fit of the other side of the plug.
The complaint further explains that when the yellow end of the earplugs is inserted into the ear, the flanges on both sides are compressed (either by the ear canal or the person’s fingers). When the flanges on the non-inserted side spring back into place, the earplug dislodges in a way that is imperceptible to the user, according to the complaint.
